· · Il-hrug tal-permess PA 1258/13 sar wara d-decizjoni ta’ appell 63/14 moghtija min dan it-Tribunal kif diversament kompost, fejn fl-imsemmija decizjoni gie spjegat is-segwenti: “Illi s-sit ghandu faccata fuq triq principali li taghti miz-Zebbiegh ghal-Ghajn Tuffieha, filwaqt li jinsab appogg ma’ dar residenzjali mibnija fuq sular wiehed fuq in-naha tal-Punent tal-fond inezami […] il-fond indezamina jinsab f’tarf ta’ ringiela ta’ djar li jinsabu fuq in-naha tal-Punent ta’ dan ir-Rural Settement.”
· · L-approvazzjoni tal-applikazzjoni PA 9583/1 7 saret wara rakkomandazzjoni favorevoli min naha tac-Chairperson Ezekuttiv, fejn kien gie ndikat kif gej:
“In principle, the construction of a new dwelling outside development zone constitutes new urban development which does not fall under a category of permitted developments in part 6 of the Rural Policy and Design Guidance, 2014. A similar proposal was already submitted in PA6138/08, however this was refused by the DCC and dismissed at appeals stage.
Subsequent to the issue of the refusal in PA6138/08, the provisions of Article 72 (2) (d) of Act No. VII of 2016 came into effect, which state that in its determination of a development application, the Planning Board shall have regard to "any other material consideration, including surrounding legal commitments, environmental, aesthetic and sanitary considerations, which the Planning Board may deem relevant". In view of the approved commitments on the immediately adjoining sites (covered by permissions PA5631/99, PA3887/04, PA2658/08 and PA2729/09) and the surrounding commitments within the residential scheme of Zabbar, the proposed dwelling unit can be considered as a material consideration in line with the provisions of Article 72 (2) (d) of the Act 2016, which the Planning Board may consider relevant.”’
Imbagħad it-Tribunal żied jgħid li ‘ fil-kaz tal-PA 1258/13, l-izvilupp jidher li kien jikkwalifika ghal zvilupp abbazi ta’ kriterju 3 ta’ ‘uncommitted land’, mentri fil-kaz tal-PA 9583/17, is-sit kien wiehed tat-tip infill plot bejn zviluppi legali ezistenti.’
